The terms that govern our website and every engagement we deliver — platforms, projects, retainers and support.
HololTeck builds and operates business software and marketing services. These terms set out how we work together: scope, fees, ownership, data, support and liability.
01. About these terms
These Terms of Service govern your use of hololteck.com and any service, platform, subscription or project delivered by HololTeck ("HololTeck", "we"), a technology company headquartered in Wyoming, USA with a regional office in Doha, Qatar.
Where you sign a proposal, quotation, order form or master services agreement with us, that document prevails over these terms for anything it explicitly covers; these terms fill the gaps.
02. Our services
HololTeck provides AI integration and automation, loyalty platforms, appointment and booking systems, unified lead platforms, approval management software, mall-readiness and brand packages, marketing services, and related consulting, implementation and support.
Services are delivered either as a subscription to a HololTeck platform, as a fixed-scope project, or as a retainer. The applicable model, deliverables, timelines and fees are set out in your proposal or order form.
03. Engagement, scope and changes
An engagement starts when you accept a proposal in writing (including by email or WhatsApp confirmation) or make the first payment, whichever comes first.
Work outside the agreed scope is handled through a written change request with its own estimate. Delivery dates assume timely client input — content, brand assets, access credentials, approvals and third-party accounts. Delays caused by outstanding inputs shift the timeline accordingly.
04. Fees, payment and taxes
Fees, currency and billing cycle are stated in your proposal. Unless agreed otherwise, projects are invoiced with an upfront deposit and milestone payments, and subscriptions are invoiced in advance for each term.
Invoices are payable within 14 days. We may suspend services on overdue accounts after written notice. Fees are exclusive of taxes, duties and third-party costs (hosting, AI usage, ad spend, messaging fees, app store or platform fees), which are your responsibility unless expressly bundled.
Deposits and delivered work are non-refundable. Subscriptions renew automatically for equal terms unless cancelled at least 30 days before renewal.
05. Your responsibilities and acceptable use
You are responsible for the accuracy and legality of the content, data and instructions you give us, for maintaining the confidentiality of account credentials, and for the activity of your users.
You agree not to use our services to break the law, infringe rights, send unlawful or unsolicited messaging, upload malware, reverse engineer or resell our platforms, circumvent usage limits, or process sensitive data we have not agreed to handle.
Messaging features (including WhatsApp-based flows) must comply with the relevant platform policies and consent requirements in your market.
06. Intellectual property
HololTeck retains ownership of its platforms, source code, frameworks, components, tooling, templates and know-how, including improvements made during your project.
You retain ownership of your brand assets, content and business data. On full payment, you receive a non-exclusive, non-transferable licence to use the delivered solution for your business for the term of the agreement, and ownership of bespoke deliverables created exclusively for you where the proposal says so.
We may reference your name, logo and non-confidential project outcomes as a case study or portfolio item unless you tell us in writing not to.
07. Data protection
Each party complies with applicable data protection law. Where we process personal data on your behalf, we act as processor under your documented instructions, as described in our Privacy Policy and any data processing agreement we sign with you.
You warrant that you have a lawful basis and any required consents for the data you place in our platforms, including customer records used for loyalty, bookings, leads and messaging.
08. AI-generated outputs
Parts of our services use artificial intelligence. AI outputs can be inaccurate or incomplete and are provided as decision support, not as legal, financial, medical or regulatory advice.
You are responsible for reviewing AI-assisted content, recommendations and automated decisions before relying on or publishing them. We keep human review available for outcomes that materially affect individuals.
09. Third-party services
Our solutions integrate with third parties such as cloud hosting, messaging platforms, payment providers, ad networks, AI model providers and CRM tools. Their availability, pricing and policies are outside our control, and your use of them is subject to their own terms.
10. Service levels and support
We target high availability for hosted platforms and respond to support requests through our support channels during business hours, with priority handling for critical issues where a support plan is in place.
Planned maintenance is scheduled where practical outside peak hours. Specific uptime commitments and response times apply only where stated in a signed service level agreement.
11. Warranties and disclaimers
We warrant that services will be performed with reasonable skill and care by qualified personnel, and we will correct defects reported within 30 days of delivery at no charge.
Beyond that, services are provided "as is" to the fullest extent permitted by law. We do not warrant uninterrupted or error-free operation, or any specific commercial result such as revenue, ranking, footfall or conversion figures.
12. Limitation of liability
Neither party is liable for indirect, incidental, special or consequential loss, or for loss of profit, revenue, goodwill or data, however caused.
Our total aggregate liability arising from an engagement is limited to the fees you paid to HololTeck for the service in the 12 months preceding the claim. Nothing limits liability for fraud, wilful misconduct or anything that cannot be limited by law.
13. Confidentiality
Each party keeps the other's non-public business, technical and commercial information confidential, uses it only for the engagement, and protects it with at least reasonable care. These obligations survive for three years after the engagement ends, and indefinitely for trade secrets.
14. Suspension and termination
Either party may terminate for material breach that remains uncured 15 days after written notice, or on insolvency. Subscriptions may be cancelled with 30 days' written notice before the next renewal.
We may suspend access immediately for non-payment, security risk or unlawful use. On termination you pay for work performed up to that date; we provide a reasonable export of your data on request within 30 days, after which it may be deleted.
15. Force majeure
Neither party is liable for delay or failure caused by events beyond reasonable control, including outages of third-party infrastructure, cyber-attacks, natural events, government action or regional disruption.
16. Governing law and changes
These terms are governed by the laws of the State of Wyoming, USA, without regard to conflict-of-law rules, and the parties submit to the exclusive jurisdiction of its courts. Where a client is contracted through our Qatar operations, the parties may instead agree in writing to Qatari law and the courts of Doha.
We may update these terms as our services evolve; the current version is always published on this page. Material changes take effect for existing clients at the next renewal or 30 days after posting.
